Purpose:

This Acceptable Use Policy (“Policy”) outlines the guidelines and rules for using Bizagi AI Products and Services. This Policy is designed to ensure a safe, respectful, and productive environment for all users. By using Bizagi AI Products and Services, you agree to abide by these guidelines.

Bizagi is committed to maintaining high-quality content generated using its products and services. We aim to keep our products and services accessible engaging and trustworthy, promoting and responsible use.

1. Definitions

• AI Output: The content or results produced by Bizagi AI Products and Services based on user input and the underlying AI algorithms.
• Applicable Laws and Regulations: All relevant legal and regulatory requirements that govern the use of Bizagi AI Products and Services, including but not limited to: data protection laws (such as the General Data Protection Regulation (GDPR) in the European Union), intellectual property laws, industry-specific regulations, and any other legal standards or guidelines that apply to the operation and utilization of AI technologies and digital services.
• Automated Decision Making: The use of algorithms or AI to make decisions without human intervention, which may significantly impact individuals’ rights or interests.
• Bizagi AI Products and Services:Refers to all generative AI tools, and technologies provided by Bizagi, including any associated features, and functionalities, incorporated or integrated into the Bizagi’s cloud platform.
• Generative AI: Artificial intelligence systems capable of producing content or making decisions based on input data.
• High-Risk Use Cases: Specific use cases of Bizagi AI products and services that involve significant risks of harm to the health, safety, or fundamental rights of people or the environment.
• Human Oversight: Processes involving human review of inputs, processing, or outputs, as well as human validation of AI-generated content or decisions before such are finalized or shared.
• Profiling: The automated processing of personal data to evaluate or predict certain aspects of an individual’s behavior, preferences, or characteristics.
• Sensitive Data: Personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, genetic data, biometric data processed solely to identify an individual, health-related data or data concerning a person’s sex life or sexual orientation.
• Users: Individuals or entities who access or utilize Bizagi AI products and services.

Terms not defined herein have the meanings ascribed to them in the Master Cloud Services Agreement.

2. Universal Usage Policies

You agree to neither use nor permit others to use Bizagi AI Products and Services in any act or attempt of the following prohibited activities:

• Violate any law or the rights of others (including but not limited to, intellectual property and data privacy rights). This includes promoting, contributing to, facilitating, planning, or inciting such violations.
• Generate content that infringes on intellectual property rights, including copying or closely mimicking copyrighted materials without permission.
• Commit, promote, contribute to, facilitate, encourage, plan, incite, or further any of the following:
  • Violence, terrorism or hateful content that discriminates against or threatens protected groups based on gender, ethnicity, sexual orientation, religion, or other characteristics;
  • Exploitation or harm to children, including creating, acquiring, or disseminating exploitative content;
  • Self-harm or encouragement thereof;
  • Human trafficking, exploitation, and sexual violence;
  • Harassment, abuse, threats, stalking, or bullying;
  • Creation of malicious code, malware, or computer viruses or any activity that could disable, overburden, interfere with or impair the proper working, integrity, operation or appearance of a website or computer system; and
  • Usage or processing of any facial or biometric information of natural persons now living.

For the following purposes:

• Automated decision-making, including profiling, that produces legal effects or significantly affects substantially threatens the health, safety or fundamental rights of any individual(s);
• Systematic or automated scraping, mining, extraction, or harvesting of personally identifiable data, or similar activity, from Bizagi AI outputs, except for data you have provided as input and are legally entitled to process;

To intentionally deceive or mislead others, including misusing Bizagi AI Products and Services to:

• Generate, promote, or further fraud or disinformation;
• Create or disseminate defamatory content;
• Produce or further distribute spam;
• Impersonate another individual without consent, or legal right;
• Mislead others into believing that the AI generated content is human-generated;
• Facilitate false online engagement, including fake reviews and other means of fake online engagement;
• Conduct large-scale disinformation campaigns;
• Generate political advertisements, propaganda, or influence campaigns;
• Misrepresent the capabilities or dangers of AI systems; and/or
• Undertake similarly deceptive activities.

3. High-Risk Usage Policies

If your use of Bizagi AI capabilities is classified as “High Risk” under the definition provided in this Policy, you will be required to adopt additional safety measures mandated by applicable legislation. These measures include, but are not limited to:

A. Human Revision Procedures: Ensure that a subject matter expert who is a qualified professional in the relevant High-Risk field reviews the content or decision prior to dissemination or finalization.

B. This requirement applies specifically to content that is provided to consumers or to the general public, and also applies to decisions made about any individual.

C. You and your business are responsible for the accuracy and appropriateness of any content or decision generated.

D. No professional advice: Bizagi AI tools features are not intended for professional advice. Do not use generative Bizagi AI features to seek or provide legal, medical, financial, or other kinds of professional advice or any opinions, judgments, or recommendations without conducting your own independent consultation or research. AI features cannot replace qualified professional advice.

E. Disclosure: Clearly disclose to your customers or end users that you are using our AI Products and Services to inform your decisions or recommendations.

Bizagi Products and Services are not intended and shall not be used in any way to discriminate in the provision of employment, employment benefits, credit, housing, other economic benefits, or other essential goods and services on the basis of race, color, caste, religion, sex (including pregnancy, sexual orientation, or gender identity), national origin, age, disability, or genetic information (including family medical history) except as may be required by applicable law (such as the provision of social security benefits solely to people who meet certain age requirements under the law).

4. Accuracy

Bizagi cannot guarantee the accuracy of any generative AI output. While we strive to improve the accuracy and quality of the content that is generated by our AI-based features, the use of our service may result in content that does not accurately reflect real people, places, or facts.

When using Bizagi AI Products and Services, you acknowledge:

• The content may not always be accurate and should not be the sole source of truth or professional advice.
• You must evaluate the content for appropriateness and accuracy for your use case before sharing such content.
• You are responsible for reporting any identified biases or unfair outcomes in the AI system’s responses or behavior.

Content referencing third party products or services does not imply endorsement by or affiliation with Bizagi.

 5. User Responsibilities

All users of Bizagi AI products and services are responsible for ensuring compliance with this Policy. Thus, by accessing or using Bizagi AI products and services, you acknowledge:

• Understanding and adhering to the guidelines outlined in this Policy;
• Implementing necessary measures to prevent misuse of Bizagi AI Products and Services;
• Ensuring that any content or decisions made using Bizagi AI Products and Services are reviewing for accuracy and compliance with applicable laws and regulations;
• Restricting data access to only necessary information in order to mitigate risk and enhance privacy protection.
• Implementing appropriate security measures to protect their login credentials, use secure connections, and report any security breaches promptly to Bizagi; and
• Electing to use Bizagi integration connectors with third-party AI tools makes the customer responsible for ensuring compliance with all applicable data privacy and security regulations. Bizagi only facilitates the integration, while the customer assumes full responsibility for the proper handling, processing, and security of any data shared with or processed by these third-party services.
• Monitoring and validating any AI-generated outputs from third-party tools for accuracy, as Bizagi does not review or verify such outputs; and
• Complying with the requirements of any applicable Data Processing Agreement, Bizagi’s Technical and Organizational Security Measures, and either End User Licensing Agreement or Master Cloud Services Agreement.

6. Limitations of Liability

Bizagi disclaims liability for any consequences arising from the use of Bizagi AI Products and Services, as well as disclaims liability for any use of third-party applications that have been integrated. Users are responsible for the outcomes of their own use.
